Nungua Stool has allodial authority over Nmai Djor lands — Spokesperson

The Nungua Stool asserts that it remains the legitimate, allodial authority over the Nmai Djor lands in the Greater Accra Region.

It has, therefore, urged the public, the media and interested stakeholders to disregard claims by the Okpelor Sowah Din Family of Teshie that it owned the land.

These were contained in a statement read by Nii Bortey Afadi, spokesperson for the Nungua Traditional Council at the Nungua Traditional Council in Accra yesterday.

Nii Afadi said it was necessary to set the records straight regarding the Nmai Djor lands which according to him were part of the ancestral and customary lands of the Nungua Stool.

He averred that the position that the Nungua Stool owned the Nmai Djor land, was not only rooted in long-standing tradition but also confirmed by official records at the Lands Commission and National Archives of Ghana.

Furthermore, Nii Afadi stated that the superior courts of Ghana had issued decisions that affirmed the Nungua Stool as the rightful allodial owner of these lands, and that those judgments remain unchallenged and fully enforceable.

He cited civil appeal number J4/10/2019 and other judgements delivered by the courts in favour of the Nungua Stool.

“We therefore urge the public, the media and interested stakeholders to disregard the misleading information being circulated. Claims to the contrary represent a distortion of the truth and a deliberate attempt to appropriate lands to which the Sowah Din Family has no historical or legal entitlement,” Mr Danso added.

Nii Afadi advised grantees of the Nungua Stool being harassed to seek legal remedies in court.

“We reiterate that all subjects and grantees of the Nungua stool being harassed by members of the Okpelor Sowah Din family should mount a fierce legal resistance against them since their actions are not supported by law,” Mr Danso said.

He said the attempt by the Okpelor Sowah Din Family to rely on the Supreme Court case of Adjetey Agbosu & Others vs. Ebenezer Nikoi Kotey and Others to advance a claim over the Nmai Djor lands were untenable becsuse the Nungua Stool was not a party to that suit.

In addition, Nii Afadi stated that the decision in innthat case did not grant ownership of the Nmai Djor lands to the Sowah Din Family.

He said the inability of Sowah Din Family to produce a judgment plan to show the extent of land covered by that ruling — as confirmed by the Supreme Court Registry — further demonstrated that the judgment did not support the narrative they had presented to the public.

The Nungua Stool further rejects attempts by the Okpelor Sowah Din Family to draw Mr Ben Danso into this matter through unfounded allegations.

“Mr Ben Danso has acted solely under the authority and directives of the Nungua Stool in a professional and responsible manner. He has not claimed ownership of the land in his personal capacity. Efforts to malign his reputation appear calculated and are entirely without merit. The Stool affirms its full confidence in Mr Ben Danso and condemns any attempts to use his name to distort the facts,” Nii Afadi said.
