Supreme Court clears way for SkyTrain trial

THE Supreme Court has dismissed an application by former Chief Executive Officer of the Ghana Infrastructure Investment Fund (GIIF), Mr Solomon Asamoah, seeking to halt his criminal trial over an alleged $2 million loss to the state.

The apex court ruled that the High Court was right in dismissing his submission of no case and directing him to open his defence.

Mr Asamoah is standing trial alongside former GIIF Board Chairman, Prof Christopher Ameyaw-Akumfi, over the alleged payment of $2 million to a South African company in connection with the SkyTrain project without approval from the GIIF Board.

The accused had filed separate applications for certiorari seeking to quash the High Court’s decision and stop the trial.

Following the Supreme Court’s decision, the case will return to the High Court, where a case management conference is scheduled for Monday, October 19.

The High Court on July 2 dismissed submissions of no case filed by the accused and directed them to file their defences within 21 days.

Neither accused complied, prompting the court to grant another 21-day extension on July 30. They again failed to file their defences, resulting in a further extension to September 23.  Read More.
