The High Court in Accra has issued a bench warrant for the arrest of the directors of Blue Chip Hospitality (BCH), a Limited liability company.
The court made the order for arrest of the directors for failing to appear before it in a case of alleged breach of tenancy agreement by BCH.
It concerns a suit filed by Secret Garden Limited (TSG) as applicant and BCH as respondents.
Meanwhile, TSG has filed a motion for contempt, asking the court to commit the owners of BHC to prison for contempt of court.
TSG, in an affidavit deposed to by its Director, Doreen Klutse accuses BCH of letting a property rented it by Secret Gardens
in breach of the rent agreement between the two parties.
It is the case of TSG that the High Court in Accra granted an injunction filed against BCH to restrain it from letting, assigning or leasing the property to another person without the consent of Secret Gardens.
The applicant said the action of BCH was contemptuous and urged the court to punish the respondents who are the owners of BCH.
It said contrary to the orders of the court, the respondents had gone ahead to give/let the property out to a third-party restaurant by name La Maison, and that La Maison had commenced serious renovation works at the property on June 12 2024.
The applicant said that she attended the property on June 13, 2024, and shockingly, saw the ongoing works by La Maison on the subject matter property with the branded logo of La Mason inscribed on the property.
That further confirming the applicant’s suspicion of the respondents’ gross disregard for court and its orders, La Maison, recently provided a cheque to the applicant, purporting to be rent payment for the premises for a couple of months despite no agreement subsisting between the applicant and La Mason.
The Secret Garden Limited said this action was a clear indication that the respondents had contrary court’s orders, sold their interest to La Maison, who are now supposedly paying rent at a far reduced rate than that which was agreed to in the agreement between the applicant BCH.
The applicant stated that, the actions of the respondents show great disrespect to the authority of the court, and same has marred the system of administration of justice.
It is the case of the applicant that the sanctity and dignity of the court ought to be protected and preserved at all cost, in order that the integrity and respect of the court is upheld.
“That I am advised by counsel and I believe that, the actions of the respondents who have taken the law into their own hands, ought to be punished for the public to know that the dignity of the court is sacrosanct, and as a matter of law and fact, ought to be preserved at all times.”
“That in the light of the above, I am advised by lawyers that I have provided the necessary ingredients that ought to be proven in an application of this magnitude, have discharged the requisite burden (beyond reasonable doubt), and that the court ought to convict the respondents in order that its dignity is restored and protected.”
“That it is my humble view, that these respondents have deliberately taken the court for granted, considering the fact that they were aware of the orders of the court since their lawyer attended court for the hearing of the application and heard the ruling of the court loud and clear,” the applicant said.
