
THE High Court in Accra yesterday admitted into evidence a letter allegedly written by Gifty Oware-Mensah, a former National Service Scheme Deputy Executive Director, directing the Agricultural Development Bank (ADB) to transfer GH¢31 million into her company’s private bank account.
The document was tendered through Mr Gilbert Sebe-Yeboah, Head of the Commercial Banking Department at ADB.
He was led in evidence by Mrs Dufie Prempeh, Principal State Attorney.
Counsel for the accused, Mr Gary Nimako Marfo, objected to the tendering of the letter, arguing it was “not legible, undated, not the original copy” and that the letterhead was “so faint that it is not even readable.”
“The documents which the witness intends to tender is not legible, undated, not the original copy and in fact the supposed letterhead which he claims was authored by the accused person is so faint that it is not readable,” Nimako Marfo complained.
However, Justice Audrey Kocuvie-Tay, presiding, agreed that the copy before the court was faint but admitted the document subject to the prosecution filing a clearer copy.
“I have perused the said document and I do agree with counsel for the accused person that the writings on the said letter appeared to be very faint… Since it is not all that legible one cannot tell whether or not the original copy has a date which burden would have been on the author of that document,” the Judge said.
The Judge continued that: “My orders to the prosecution at this stage is to provide the court with a much legible clearer letter.”
Ms Oware-Mensah pleaded not guilty to charges of causing financial loss to the state exceeding GH¢38 million, money laundering, stealing, and using public office for profit.
On October 13, the Attorney-General (A-G) filed criminal charges against Mrs Oware-Mensah and Mr Osei Assibey Antwi, former Executive Director of the NSA.
The two are accused of authorising payments to 69,000 non-existent national service personnel, causing significant financial loss to the State between August 2021 and February 2025.
